Tras los acontecimientos de los últimos días relativos a la "estafa filatélica", hoy publica El Pais que
Anticorrupción ha acusado a las empresas Afinsa y Fórum Filatélico de estafa, según las querellas hechas pública hoy después de que los jueces que instruyen cada caso levantaran el secreto de sumario de su investigación. En el caso de la primera, las Fiscalía ha acusado a cuatro directivos y a un suminstrador de sellos de estafa, falsedad documental, un delito contra la Hacienda Pública, insolvencia punible y administración desleal. Además, considera que la compañía está en una situación de "absoluta insolvencia". En el caso de Fórum Filatélico, se calcula que tiene un déficit patrimonial de 2.000 millones de euros.

La Fiscalía Anticorrupción tiene previsto solicitar hoy el nombramiento por parte de la Agencia Tributaria de interventores en lugar de los actuales consejos de administración de Afinsa y Fórum Filatélico. El fiscal cifra el desfase patrimonial de Afinsa en 1.105,9 millones y más del doble en Fórum Filatélico, 2.416,3 millones, y señala que ambas compañías están ‘claramente en quiebra’.

Normas solapadas, desarrollos reglamentarios que nunca llegaron, artículos que se ponen en 1998 y que se eliminan en 2005… La actividad que han desarrollado Afinsa y Fórum siempre ha sido un concepto etéreo dentro de la legislación.
Cualquier abogado especialista en instituciones de inversión (el primer ámbito económico donde se mira para intentar calificar jurídicamente a Afinsa y Fórum) al menos citaría dos leyes, un real decreto, y en especial una disposición adicional (la cuarta).
Es un laberinto jurídico que se ha ido superponiendo desde el año 1988, con la primera Ley del Mercado de valores. Con aquella ley en la mano, y según explican fuentes jurídicas, las actividades de Afinsa y Fórum Filatélico no estaban ni prohibidas ni permitidas.
Sencillamente era como si no existieran. Aquella ley identificaba una serie de actividades financieras consistentes en la captación de ahorro del público, entre las que no estaba la fórmula de Afinsa ni la de Fórum. En 1998, se incluyó un párrafo en el que se venía a decir que si no se estaba en la lista de actividades descritas en la ley, no se podía captar ahorro del público, como parece que financieramente han venido haciendo Afinsa y Fórum por el relato que hace la fiscalía en sus querellas.
Pero aquel párrafo, que evidentemente podía haber hecho saltar las alarmas sobre Afinsa y Fórum, se volvió a eliminar en Real Decreto 5/2005 de la Ley de Mercado de Valores. Entonces, se miró a la Ley de Instituciones de Inversión Colectiva, que establece una serie de requisitos para que una empresa pueda ser catalogada como tal, entre ellos, el de la de repartir resultados en función de un colectivo de inversores, como un fondo. Técnicamente, Afinsa y Fórum escapaban a este último requisito, y por eso se creó la disposición adicional cuarta, para las empresas que comercializaran sellos, obras de arte y antigüedades con la “formalización de un mandato de compra y venta de bienes u otro contrato (…) percibiendo el precio de adquisición de los mismos o una comisión y comprometiéndose a enajenarlos por cuenta del cliente, entregando a éste, en varios o en un único pago, el importe de su venta (…)”.
Lo llamativo de esta disposición es que derivaba las competencias a las autoridades en materia de consumo. Algunos especialistas se preguntan por qué, y lo describen como un ejemplo de cómo se ha ido pasando la patata caliente, de una a otra ley, y de una a otra institución. Como ahora ocurre con los partidos políticos, que todos echan balones fuera.
El portavoz de Economía del Partido Popular en el Senado, Javier Sánchez-Simón, echó en cara ayer al PSOE que se podría haber evitado el caso del supuesto fraude de Afinsa y Fórum Filatélico si se hubiese aplicado la Ley de Instituciones de Inversión Colectiva, que entró en vigor en 2004 y fue aprobada en 2003 por el Gobierno del PP.
El portavoz popular de Economía criticó que no se haya desarrollado reglamentariamente la ley ni se hayan realizado actuaciones con el fin de aplicarla. El martes, el Gobierno dijo que la responsabilidad era de consumo, cuyas competencias están transferidas a las comunidades autónomas.
Por su parte, el director de Consumo del Gobierno vasco, Rubén Mendiola, mostró su malestar por la actitud del Gobierno central al atribuir únicamente a las Comunicades Autónomas la responsabilidad.
Ser o no ser entidad financiera, esa es la cuestión
En qué medida lo que hacían Afinsa y Fórum era sólo comprar y vender sellos, o por el contrario, actuaban como auténticas empresas financieras de captación de ahorro, cuya regulación es exhaustiva. En las querellas simultáneas contra las dos empresas por los fiscales anticorrupción se menciona expresamente que su operativa era totalmente financiera, e incluso se refiere a la actividad del préstamo, en el sentido de que eran los clientes los que prestaban a las entidades a cambio de una remuneración, como si un usuario de banca decide meter sus ahorros en un depósito.
¿Hasta qué punto son responsables las autoridades por no clarificar juridicamente la actividad de Afinsa y Fórum? Los abogados consultados señalan que llegado el caso, se podría incluso pedir responsabilidades a la Administración por no haberlo hecho, aunque señalan que esta vía argumental sería fácilmente desechable por un juez, precisamente por la legislación al respecto es la que es, y Afinsa y Fórum, legalmente, no son entidades financieras.

BEIJING (Reuters) – The boss of a Chinese toy manufacturing company involved in a Mattel recall after its products were found to contain excessive lead levels has hanged himself, Chinese media reported on Monday.
Zhang Shuhong, a Hong Kong businessman in his 50s and boss of the Lida Toy Company in the southern province of Guangdong, was found dead in his factory workshop on Saturday, the semi-official Southern Metropolitan Daily said.
About 1.5 million preschool toys made by Lida Toy, a Foshan-based contract manufacturer for Mattel Inc.’s Fisher-Price unit, were recalled across the globe by the U.S. company last week.
The recalled toys included popular preschool characters such as Elmo and Big Bird and dozens of other items. The case was the latest in a deluge of product safety scares that have tainted the “made-in-China” brand.
Lead paint has been linked to health problems in children, including brain damage. China’s quality watchdog had banned Lida from exports.
A close friend of Zhang who was also one of the major paint suppliers for the company sold the problematic paint to Lida, the newspaper said.
“(He) was so evil-hearted to have sold the fake paint to our boss … our boss was ruined by his best friend,” a manager of the company, surname Liu, was quoted as saying.
Lida was not immediately available for comment. Calls to its factory went unanswered. A spokeswoman for Mattel in Hong Kong said she was not in a position to comment.
Police were investigating the case, the newspaper said.

(Berlin, 23.08.2007) Die Gemeinschaft der oeffentlich-rechtlichen Rundfunkanstalten hat die Wissensplattform akademie.de ueber die Rechtsabteilung der GEZ abgemahnt: akademie.de soll sich dazu verpflichten, “nicht existente” bzw. “falsche” Begriffe wie “GEZ-Gebuehren”, “PC-Gebuehr”, “Gebuehrenfahnder”, “GEZ-Anmeldung” oder “GEZ-Abmeldung” nie wieder zu verwenden. Das Verbot wird damit begruendet, die Nutzung der Begriffe diene nur dazu, “ein negatives Image der GEZ hervorzurufen”.
UEber eine “strafbewehrte Unterlassungserklaerung” soll http://www.akademie.de fuer jede weitere oeffentliche Verwendung eines Verbotsworts 5.100 Euro an die GEZ bezahlen.
Bisher hatte akademie.de kostenlose Tipps und Musterbriefe im Internet veroeffentlicht, die bei der GEZ-Abmeldung oder der Klaerung der PC-Gebuehrenpflicht helfen sollten. Illegale Praktiken wurden weder empfohlen noch erlaeutert. Die Beitraege sind jetzt abgeschaltet, Besucher der gesperrten Seiten werden automatisch auf diese Infoseite umgeleitet, die ueber die in der Abmahnung uebermittelte GEZ-Wortverbotsliste informiert. Bis zur weiteren Klaerung der Rechtslage erklaert sich akademie.de wegen der Seitensperrung zur “GEZ-freien Zone” und setzt dafuer ein Logo auf die Webseite.
Bei den von den oeffentlich-rechtlichen Rundfunkanstalten unter Zensur gestellten Begriffen handelt es sich – wenigstens im Internet – um umgangssprachlich gelaeufige Wortbildungen zum Thema Rundfunkgebuehren. Laut Google-Sucherergebnis vom 23. August 2007 finden sich im deutschsprachigen Internet allein die Verbotsbegriffe “PC-Gebuehr(en)” auf 37.100 (31.900) Webseiten und die angeblich nicht existente(n) “GEZ-Gebuehr(en)” auf 99.500 (225.000) Webseiten.
Die Suchergebnisse bei Google fuer den untersagten Begriff “GEZ-Gebuehren” am 23.08.2007: http://www.gez.de liegt auf Platz 1.

Die Abmahnung zur Unterlassung “nicht existenter” oder “falscher” Begriffe auf der Website von akademie.de betrifft damit potentiell viele tausend andere Firmen, Webpublisher, Institutionen oder Personen, die die von der GEZ verbotenen Begriffe im Internet publizieren oder in Foren kommunizieren. Wegen des allgemeinen oeffentlichen Interesses werden Teile der Original-Abmahnung der Rundfunkanstalten zu Dokumentationszwecken bei akademie.de veroeffentlicht.
Ein Worthaeufigkeits-Vergleich per Google-Abfrage zeigt, dass die – nach GEZ-Meinung “nicht existenten” bzw. “falschen” – Begriffe auf deutschsprachigen Webseiten insgesamt etwa 3.000 mal haeufiger vorkommen als die Ersatzformulierungen, die in der GEZ-Wortverbotsliste als “richtig” bezeichnet werden. Nach Umschreiben der verbotenen Begriffe auf den Webseiten in abmahnsicherere “richtige” Begriffe werden die geaenderten Texte bei Internet-Suchabfragen in deutscher Normalsprache wohl kaum noch im Suchergebnis auftauchen.
